Well, the concerned Property is under whose illegal possession, which you have not clarified yet. Moreover, What solution do you need from the end of lawyers like me, you have not clarified that too. From what I have understood despite you jot writing clearly, I think, you need possession and want to evict the tresspasser, in such a case, you need to file a Civil Suit to get Possession.
