MCS ACT - 1960 - (Penalty for encroachment of common spaces)

Hello,nnRegarding the MCS ACT (Maharashtra Cooperative Societies Act - 1960) - (Penalty for encroachment of common spaces), I am assuming that encroachment of common spaces is not allowed even if the society was not formed at the time of encroachment but possession was taken by the residents ? Is this correct ?

Yes, you are absolutely correct - Encroachment of the common areas in a Society is an offence and falls under the category of Public Nuisance. You can file a Criminal as well as a Civil Case to remove such encroachment.
