Loan on family property taken by my brother and without my consent

06-Jan-2025 (In Property Law)
We are two brothers who live in a common house along with my father. My brother took a loan on our house land 1 year ago without taking my consent but had father’s approval. Can I, i) contest this in court? ii) take a loan myself even if he does not allow but my father allows?

Sir if its your fathers self acquired property then your consent is not required but if it is an ancestral property then there is your interest in it and you have a share in it then the consent is required. You can contest for your share sir in this matter

hi as per your facts father he is the absolute owner of the property. only he or anyone whom he sponsors can take loan. for this you don't require any approval of your brother. in case of your brother, loan must have been taken and father must have given guarantee. there is no requirement of any permiSion
