Liquidation of Property of Deceased Father
06-Jun-2025 (In Property Law)
I am an unemployed 40 year old who lives in a building that belongs to his late father. My Brothers have threatened me and asked me to vacate the premises on the ground floor as it belongs to my mother.
I do not want to leave. How should I petition the court and send them a legal notice?
if the property belongs to your father then you have also inherited the relevant percentage of share as per the succession laws. After your father's demise, the property devolved upon the legal heirs of your father I.e. your mother, your brother and you.
If the ground floor belongs to your father, then the question of vacating the property does not arise since you are also a co-sharer of the property. If the threat continues the you can file a suit for partition.
