Q: Liquidation of Property of Deceased Father

I am an unemployed 40 year old who lives in a building that belongs to his late father. My Brothers have threatened me and asked me to vacate the premises on the ground floor as it belongs to my mother.I do not want to leave. How should I petition the court and send them a legal notice?

you must do it. can you tell me your father transferred this property during his life time? if your father died intestate, your must get a share of his property. so don't worry no body will evict you. but you should take shelter under law.

Q: Delay of my partition suit by my lawyer.

My lawyer has filed a partition suit case against my brother who has captured my half share land with construction one and half years ago. My brother lawyer has appeared but does not give w/s till now. On successive two dates,My lawyer has hold me to do ex parte because w/s time is over. Today was date but my lawyer's assistant told me that one advocate is passed away so court will be closed, In the previous date he had done the same,.Here my brother's harrasment is increasing day by day.Suggest

time limitation for w/s is 90 days after receiving summons. although 30 days may be extended for this. total 120 days. after 120 days court may pass exparte. if any advocate die, bar association may declare pen down for this day. no advocate will go against bar association.

How can I get fast divorce from husband along with a fat alimony.

I am living with my family in my brother's house for the last 32 years, but not as a tenant. My brother is alone since his wife died and he has no issue. I am a senior citizen over 70 years of age. My wife is also a senior citizen. We have a married daughter. Can my brother evict my family from his house?

Legally, your brother has the right to evict you, but he must follow proper legal channels, and you may get temporary protection from the court based on your age and long-term residence. However, you do not have ownership or tenancy rights, so a permanent claim on the house is unlikely unless there's a will or gift deed in your favor.
