Legality to update name of legal heirs in property card
10-Nov-2023 (In Property Law)
With regards to an Inherited Property, Is it mandatory in law to update the names of all legal heirs in the Property Card ?? If yes, can some legal heirs object or prolong the updation and if No, how long can the inherited property stay in the name of a deceased person, in whose name the Property stands.
As a matter of fact and matter of right and matter of law it's important to update name of all legal heirs. What is the point in prolonging the objection? It will stay in the name of the deceased till the requirements of the concerned authorities doing the execution are sufficed with proper legal documents.
Yes, you have to update the name of legal heirs on the property card of the property which you have inherited. Whether the property is conveyed by way of WILL? If there is a WILL then you require to obtain Probate from the Court and with the copy of the same you need to make application to the registrar for updating your names on property card. And if there is no WILL then you have to apply for Letter of Administration.
