Legal steps to be taken in property dispute after it is distributed

08-Jun-2023 (In Property Law)
I need suggestions on property distribution, My Dad is the eldest brother from total 5 brothers. One year back they follow all the legal steps & distributed the property. Now one brother is saying he is not happy with the property which is given to him & he wants some other property. Now the query is, he is doing this on purpose, once his requirement is fulfilled he will ask for something else. Can you tell me how can we stop him to do this? what are the leagl terms/ways which we can use to scare him or if required use it..

You can send notice to him through advocate and then you can file a case in civil court.

This is my response to you:
1. If the property was distributed by the order of the court under the partition suit then that brother cannot claim anything anymore;
2. If he wants to claim let him approach court for the same;
3. Once the property is distributed then it cannot be re-distributed without the leave of the court;
4. If he still is being forceful then file a application for injunction order against him;
5. Once you get the injunction order against him he cannot enter the property till the court finally adjudicates upon the issue.

As mentioned, if the property is distributed by following the due process of law, then your uncle won't be able to create any right in any of the distributed property. Kindly let me know if the distribution was equal in share and weather his consent was obtained without any force or pressure. For any further clarification kindly book a consultancy call.
