Lease expired. on renewal, died wife signed but only son didn't sign
21-May-2025 (In Property Law)
You took a house on lease for 2 years.
The lease expired.
You wrote a renewal for 2 more years on the back of the same document.
The original owner (landlord) is now deceased.
The owner's son did not sign, but the owner's wife (widow) signed the renewal.
What will be legal issue. how to fix it.
The renewal of the lease might be disputed due to the following reasons: *Lack of signature from the owner's son*: If the son is a co-owner or has a share in the property, his signature might be necessary for a valid renewal.*Authority of the widow*: While the widow signed the renewal, it's essential to determine if she had the authority to do so on behalf of the estate or if she is a co-owner.
Issues:
*Validity of Renewal*: The renewal might be challenged if the son or other co-owners don't recognize the widow's authority to sign on their behalf.
*Dispute over Tenancy*: The son or other co-owners might dispute the tenancy agreement, potentially leading to eviction or other legal issues.
