Key points of case
1. Tenant from past 20 years
2. Only at the time of initiation rental agreement was prepared. Ie . In year 1999. Henceforth which no deed was redrafted or addendum prepared.
3. In 2002 one more area gave for rent but no deed prepared
4. Everything went as per mutual understanding.
5. Rent was received in cash and no receipts was issued in return.
6. Electricity was borne by landlord which was further collected by tenant.
7. Since 2 years electricity not paid.
8. Since feb’20 rent not received
9. Electricity was cut in Feb’20 henceforth which police case was filed by tenant and electricity reactivated
11. Since feb 20 no rent was paid
(Rent was ₹19500 but no rent paid)
12. Oct 20 end electricity was cut
13. Tenant filed a case against landlord - attempt to torture
14. Tenant claiming he paid all rent to police
15. Tenant claiming rent was only ₹10500 and he paid all rent until September
16. Tenant filed legal
In this case, I would like to know it's separate EB meter line or not, you can preferred two petitions before the rent control board for Willful default and another one fixation of fair rent and the further property is given for commercial or residential propose. nowadays law has changed in favour of the landlord if there is no valid agreement then you can approach the court for eviction of the tenant your tenant cannot force to continue after after the end of the agreement period or non-acceptance to extend the agreement if there is no any agreement the landlord can approach the proper Court for eviction
