Land question (police/municipality)

27-Mar-2025 (In Property Law)
In one of the districts in Maharashtra, I have piece of land (10 guntas) which is there since last 25 years. We had old fence and since it was damaged we recently put new fence to the land. Now one person has come forward stating 3 guntas of the land in that belongs to and has filed police complaint and also complaint with municipality. They are asking me to prove: 1. Should I take those complaint (police & municipal) seriously? 2. Should the police or muncipality not ask that person to prove?

Taking the Complaints Seriously: Yes, you should take both the police and municipal complaints seriously. Even if you have been in possession of the land for 25 years, the person claiming 3 guntas has initiated a legal process that could escalate if not handled properly. Burden of Proof: While the person claiming the land should also provide proof, you should proactively present documents to establish your ownership. This includes the sale deed, property tax receipts, survey records, and any other land title documents. Municipality’s Role: The municipality may ask both parties for evidence. If you have legal documents showing ownership, submit them immediately. You can also request a land demarcation survey through the local revenue department to clarify the boundary. Legal Action: If the person persists, consider filing for an injunction in civil court to restrain them from interfering with your possession. Also, lodge a counter-complaint if they are making false claims.
