land acquisition in Palwal (Haryana) without notification by govt.

PWD, PALWAL constructed a road on our land in 1998 without serving a notice to us. we sent several letters ( in 2003 to 2006) to the concern dept. for compensation but all the time they refused and we filed the case in haryana highcourt in 2006 for compensation but in 2007 court ordered that prove your ownership in lower court. again we filed a case in lower court,Palwal after 4 years we withdraw our case due to some family problem.ow PWD,PALWAL agreed to give us the compensation from the rates of 1998 but we are denied to take it. we want today's market rate.Please advice and help us.

As the High Court said that you need to prove the ownership. ownership is very impt. and you need to show that to get the increased compensation amount. therefore the Govt. is looking into the matter and may pass new bill

The Haryana government will soon bring a new land acquisition act and acquire land as per it, Chief Minister Manohar Lal Khattar said here Friday.

The proposed act will be significant given the fact that several districts (13) in Haryana are adjoining national capital Delhi or are part of the National Capital Region (NCR).


Speaking on the provisions of the proposed bill, Khattar said that except for a few cases, consent of farmers will be taken before acquiring their land.

"Barring defence projects, affordable housing, infrastructure, industrial corridor, railways etc, no land would be acquired without the farmer's consent," he told media here.

Khattar, who heads the Bharatiya Janata Party's (BJPs) first government in Haryana, has completed six months in office.

The chief minister claimed that a number of development projects have been launched in Haryana in the last six months. He said that no-tolerance to corruption was showing results.

He said that the Haryana government will form a Special Purpose Vehicle (SPV) with the Indian Railways to strengthen rail network in the state.

Haryana's new Industrial Policy will be announced within the next 15 days which would spur growth in all districts, he said.

Khattar also said that with the efforts of his government, work on Kundli-Manesar-Palwal Expressway has been re-started and it would be completed in a phased manner.

The expressway links four National Highways - No. 1, 10, 8 and 2, running through the districts of Sonipat, Jhajjar, Gurgaon, Mewat and Palwal.

Things do not look too bright for you but you could fight for better compensation if you have written offer for compensation with you from PWD. If not then it would recommendable that you accept the compensation being offered to you as per the rates at the time at which it was acquired and ask them to pay you interest on the amount from the time it became due to you.
