Joint owned property father first owner in bank want to transfer to me

Hello Sir/Madam, I have a property in Thane, Maharashtra. Jointly owned by my Father and me. It has my Father's name as first owner and my name as co-owner. I have home loan on this property from ICICI bank, all the original documents are in ICICI bank's custody. My father wants to remove his name from property and transfer the ownership solely to me alone. I have few questions regarding this. - What will be the procedure to execute this agreement? - How much I will have to spend to execute this? - Is it possible to execute this when all earlier original documents are in bank's custody? - What if I take MOU and POA signed from my father and register? Can this be alternate/substitute approach/option to the executing new agreement?

Dear Sir,

You can do the transfer only after you getting the original decuments from the custody of the bank. If you make POA or MOU but ownership may not changed in record of Registry.

So I advice you that, after you getting the original decuments (Sale deed) theirafter father can transfer ownership rights on your name by making Gift deed between you & Your father,

yes ofcourse
u execute the documents of relinquishment deed ( HAKKA SOD PATRA) registered before sub registrar...
at the time of registration u attached the xerox copy of sale deed and other documents... which is required....

then the abovesaid deed xerox copy sent to the Bank
for change of circumstances
then mutated ur name of city survey record...
