Is NOC required for transfer through Settlement Deed

27-Dec-2023 (In Property Law)
Hi, My grandfather executed a Settlement deed in my Father's favour. My Grandfather has 2 sons and 3 daughters, one of the son is deceased(my father's brother). My Grandfather passed away leaving behind my grandmother. Is a NOC required from 3 daughters and heirs of the deceased son for transferring the property to my Father or Grandmother with Settlement deed as reference.

Yes, for avoiding future legal consequences, you should get relinquishment deed with registration, and use in khata transfer. Visit and take guidance properly.
Need to get deed with including all disputable property. More information consult.

sir/madum, i learnt your question. I am not learning whether the settlement deed done alone to your father or including his deceased brother. If the settlement deed was done including all family members and so for has not been transferred kathas, then no need of NOC from others. If the share of deceased brother was not decided earlier, the daughters NOC is require. If your father share had been allotted with consent of all the family members, then, no need of NOC . you have not stated correct facts. So, i can't clearly, give my opinion. If you bring all document, i can advise you.

You have not mentioned whether the property in question is ancestral or self acquired by your grandfather. NOC will be required only if the property is ancestral in nature. In case of ancestral also it will depend on the date of settlement deed and the death of your grandfather.
