Is it legal to sell a property without any papers except Light bill?

A person who stayed in a property without papers (has electricity bill in his name) for 25+ years passed away and one of his son tried to sell it to my father for which he made an agreement for paying his 18 lakh rs loan amounting to a total of 30 lakhs. The property is only 170 sq mt and the amount charged is way too high in the area. Is it legal to sell this property which has no papers except for light bill? Can it be considered fraud? Is there any way to file a case and get back the money?

Hello, I have perused your query. In such circumstances firstly, if the opposite party has not acquired the title, right or interest in the property by way of adverse posession then they will not be able to sell off or dispose off the property to a third party. If their is no decleration of title in respect to the property in favour of the person holding the property he / she will not be entitled to sell it off. Hence, you can ask for recovery of the amount you paid given the fact that you should fall within the limitation period of recovery.
