31-May-2023 (In Property Law)
I have a flat near Dombivli and since 2 years the flat is empty we live out of town but still society charging for me for maintenance is is really applicable to me if flat is empty
Well, Society is doing the right thing. So what, if you are not using the Flat, but as you have occupied flat in a Society, then you should pay the Maintenance Charges. This is the Law of the Land which you have to follow it.

Yes the maintenance is applicable to you even for your empty flat. The maintenance is not charged upon the resident because the flat is in occupancy or use by the resident it is charged for the maintaining cost involved by the society for society expenses. You cannot defer to not pay the said amounts.
