Is family tree of previous owner required while selling property?

26-Apr-2023 (In Property Law)
Hi, I had bought a property back in 2005. I have it registered in my name. The property which I bought was allotted to previous owner's father. After his demise, it was transferred to his sole daughter. She sold the property to us in 2005. We didn't collect their family tree, but the property is completely registered in our name. Now I am planning to sell it. Do I now require family tree of the previous owner or only my family tree is sufficient?

You would be required to have a family tree of the previous owner just to ensure that there were no other person/s in the previous owners family who had a right on the property. If the same is not available then as it is there is an indemnity clause in any sale transaction wherein you indemnify the purchaser for any defects in title.

As we see, you have not collected the family tree. For the purpose of selling the property, you may require the family tree of your vendors father as after his death (i.e., the vendors father), the property was succeeded to by your vendor. In such circumstances, the prospective purchaser may insist on the family tree in order to be certain that there was no other LR's other than your vendor.
