Is a gift deed possible after the person died

Sir My father expired one year ago We have a house and he taken a loan on that house for construction now we want to clear the loan and transfer the property through gift deed to me is it possible sir please reply me

It is possible when all the legal heirs agreed for clearance of the loan and it can be transferred in your favour. There is no possibility to transfer through gift deed since your father died. First of all clear the loan and all the legal heirs shall furnish NOC to transfer the property in your favour before the SRO. This is including your mother, if alive (SORRY).

In the absence of your father, there can be no gift deed. The property devolves upon all legal heirs by operation of law, If you spend any amount on construction/loan, you can claim it from the animus i.e. the total value.
