Intention of evading Stamp duty charges in gift deed

My great grandfather had two wife’s , I am the heir of 1st wife & the second wife had one son who died issueless ,before his death in 2013 he has gifted inherited property received from his own mother to his cousin brother.In gift deed the relationship has been mentioned as his own brother to avoid stamp duty charges, & as he was diabetic & had less memory at the age of 80 yrs the donee has miss used this situation to get the gift deed done in his name.can I file a criminal case against the donee & civil suit for cancellation of gift deed.

As you infomred, it is his mothers inherited property. You are the related to first wife side only.

Id the property is belonged to your great grand father's and who has died intestate then you have right on the said property.

Now it is his mothers inherited proeprty.

So you dont have any right over the said property in any manner. You cant file any criminal case.

In case if any case is to be filed against donee that can be sone from his mother side only that was her inherited property. The person who are climing under his mother side can riase all these points that you sought in queation.
