Independent house common area issue
17-Apr-2023 (In Property Law)
I am owner of whole independent house(g +1).
I gifted only first floor mentioning only about first floor.
My question is area between entrance to first floor staircase is common. Can they use this area other than to access the staircase to first floor as I live in ground floor and they do as they please in this area.
In gift deed I only mentioned first floor.
Whatever is mentioned in the schedule of the gift deed is considered to be gifted rest everything does not count
Entrance is common area which will be used for entry to the first floor and hence that is common area which cannot be separated unless there is another stair case for the entry into the first floor
