I have perused the contents of your query and would advise you to seek a detailed consultancy from a lawyer having expertise in property matters. Further it needs to be ascertained whether it was a self acquired property or an ancestral. Whether he died intestate ??

this can not happen. if the deceased died intestate, i.e. without will then the property will go to the next survivors and in this case wife and son both will have their respective shares. mother has her own share, plus she will get one part from his son's share as well.
