Illegal construction made by grabbing our ancestral property hosted by a club authority. Through club authority, few notorious land brokers/promoter grabbed our property. I complaint (GD)to local police & also District magistrate & Municipal corporation (writing complaint). But no strong action wasn't taken. Finally I lodge 144(2) petition at SDM COURT against illegal construction & property grabbing. Police send a report to court mentioning that the allegations was correct. Court order to SDLRO & BLRO in 1st hearing to send a enquiry report before 2nd hearing. Property is in my grandfather's name. Before he died, he made a will in favour of my father, two uncles. The probate was granted. One of my uncle Executor of the will & also Administrator of property currently as per Probate. But my uncle didn't taken any legal step against outsiders & also didn't distributed property among the successors as per will. I recover our property & protect my father's share. What is right way out?

immediately you have to approach appropriate legal forum for redressal of your issues. if you are still facing the problem of encroachment of your property or if the problem has not be solved yet then you can approach the High Court by police in action or challenging the action of the SDLRO & BLRO and hopefully by direction of the High Court your problem be solved in a short period of time.
and for partition of the property if your uncle is not ready to divide aur demarket the property then you have to approach the appropriate Court by filing suit for partition. proper legal notice may also be able to do the job.
