There is an illegal construction in my property by the co owner of my property. I want to remove it because of it’s crippling condition and water saturation. There was a court case to remove it and now there is a stay for since 5+ years now. What do i do

Dear Client, I understand the frustration of facing a 5+ year stay on removal proceedings for illegal construction that continues to damage your property. As an advocate practising property and civil law, I can guide you through multiple strategic approaches: first, we’ll challenge the existing stay order by filing a detailed application with fresh evidence—particularly a structural engineer’s report documenting the deterioration and safety hazards, which significantly strengthens our position. Simultaneously, we’ll pursue parallel regulatory action through your local civic authority under unsafe structures provisions, and if applicable, escalate to RERA for any violation of building norms—regulatory pressure often accelerates judicial outcomes. I’ll also review the co-owner’s title and construction details to identify breaches of building bylaws, which provide additional leverage. Given the prolonged stalemate, mediation may be strategic, but only after we’ve established our legal strength. I’ve handled similar property disputes involving encroachments and illegal construction, and I’m confident we can move this matter forward. If you’d like to engage me to review your court documents and chart a concrete action plan, please feel free to share the case details and we can discuss

If the stay has continued for over 5 years, you should consult your lawyer about filing an application to vacate or modify the stay and request an early hearing, especially if the structure has become dangerous. If there is an immediate risk to life or property, you can also approach the local municipal authority for inspection and necessary action.

Since there is already a pending court case and an interim stay order, the structure cannot ordinarily be removed until the court modifies or vacates the stay. However, if the construction has become dangerous or poses a threat to life or property, the client should: File an application for vacating or modifying the interim stay on the ground of changed circumstances and prolonged continuation of the stay.
