I can help. If this is a Maharashtra flat and you are gifting 50% to your husband, the exact stamp duty depends on the property’s location and applicable concession. A gift to a spouse can attract a concessional duty under Article 34, with registration charges separate. Whether gifting 50% is suitable depends on your ownership, tax implications and whether you want to retain control. Tell me the flat’s city and approximate Ready Reckoner value, and I can calculate the likely charges and advise whether a gift deed is the best option.

Yes, you can gift 50% of your share in the property to your son. The stamp duty is minimal Rs. 200 and the registration charges would be approximately 5,000–6,000. However, the exact charges can vary depending on where the property is situated. In Mumbai, the stamp duty is Rs 200.

Yes, of course, you can gift 50% of your property. Regarding the stamp duty, you have to pay according to the share you've gifted, i.e., 50% of the total stamp duty calculated. As for the registration fees, it is a nominal 1000 rupees. For more queries and registration work, consult us. Best Regards, Adv. Gopal Mahida
