I want my share of my grandmother's property, which my uncle does not
17-Jul-2023 (In Property Law)
My grandmother has some land of our ancestors, which has 3 parts, one is my father and two are my uncle. We did not live there, but now after the death of my father, we want our grandmother to give us our land in writing but my Uncle we do not want to give part of that land! What can I do legally
You can claim partition of the share belonging to your father. This can be done by first sending the legal notice to the proposed legal heirs and asking for the partition and after that if they are willing to settle then signing a partition deed and after that mutation thereof. If they are not willing to settle, then we can approach court for partition.
Hello, I have perused your query.
In these circumstances you have an option to claim your share by virtue of filing a partition suit in a civil court of law. Also, if the property in question is ancestral in nature then each legal heir will be entitled to an equal share in it as per the Hindu Law of Succession.
You can approach the court for crystallization of your share in that undivided estate and get its respective possession.
