How will land be divided when we want to sell the land ?

Dear sir /Madam, we have land on my grandfather name, we legally Moved to prepared a document instead of patta.. document is prepared with my father and his brother name(2gents) ... actually number people available in patta is 4 (2ladies & 2gents).. if we sell the land means we compusary give 50% to the 2ladies , that means total amount divided by 4 ? If we give less amount means any legal procedures taken? Kindly give the clarification pls.. thnx in advance..

From what you stated it is assumed that the issue is the division of your ancestral property. The four people may be two brothers and two sisters. when you go for a settlement all have got equal rights . Each will get only one fourth of the property.

From the facts you have stated, I learn that it is an ancestral property derived from your grandfather and that there are four legal heirs, including your father, your father's brother and two women. You have further stated that the patta shows the four persons as joint-holders of the property. As such, all the four persons are entitled to one-fourth share each. The two women may renounce their respective shares in favour of the two male members, but they should do so voluntarily and in writing. In the circumstances, it is better to get a family settlement deed properly drafted which should evidence voluntary renunciation of their respective shares by the two women in favour of the said male members (your father and his brother), executed by all the four legal heirs and duly registered with the Sub-Registrar.
