How to transfer ownership of flat to nominee’s name

My wife passed away last year and all property are on joint name except one which is on her name. I got 2 minor & a major child. She had put me as 100% nominee. I had given application to society to transfer flat on nominee’s name. My in laws stays in same building and we are conitnously trying to get in touch with society MC but no reply from their end even after 2.5 months. What to do next?

Very firstly we need to apply to high court and get your succession certificate or probate petition.
I would explain you briefly about what is the meaning of this terms. So when any person dies at that time you need to go to high court and submit all the documents and the property gets divide either according to the will or according to the succession. So after getting that we would have formal documents to prove our things.
Next when it come to society and the owner has already transfer the flat in the name of nominee at that time a formal letter should be written to them even after repetitive request the flat is not transfer we can go to the registrar office and we can make sure that the needful is being done.

Managing Committee ought to have replied to you whether approving or denying the transfer to your name. However, merely being the nominee does entitle one to become the owner after death of real owner. The immovable property can be transferred validly only by properly executed, stamped and registered document ; order of the court; through laws of succession. If your wife has died intestate I. E. without leaving any will, and assuming you are Hindus, you and your children equally inherit her property or her share of property.

If society is not responding to your request, you may file suit against the society for seeking delcaration that after demise of wife, you and children become owners and therefore society is bound to transfer share in your name.
