How to transfer flat to nominee after death of flat holder?

My father died in Nov 16, leaving behind spouse, 2 sons, 1 daughter. He had made nomination of his flat on proportion basis to above family members. Now we want to transfer this flat to my mothers name and we (2sons &1 daughter) want to be fresh nominee. (1) What is the procedure of the same. (2) whether we havebto notify the same to registrar? (3) how clear marketable title is created?

Dear querist, ideally you should execute a release deed in favour of your mother and then apply to the society by filing the prescribed forms. This will not only make the title marketable and will be from any glitch

Nomination of flat is with respect to the society.you can give your mother's s name as nominee in the society where the flat is.you have to go for heirship certificate in order to get a marketable title, it appears that your father has not made any will.

Dear sir, you need to execute the Release deed and register it with SRO so as to enable Society to mutate name of your mother as owner of flat. After registration of Release deed, your mother will nominate both the brothers as nominee of flat. Kindly contact us for any queries
