How to stop my elder brother to sell my parents properties

29-Aug-2023 (In Property Law)
Dear Sir/Madam, I am Muslim by religion and right now I am working in Saudi Arabia my problem is that my parents both died and left no "will" and they have properties including house & agricultural lands in District: Muzaffarpur, Bihar and my elder brother is very greedy and I have fear and doubt that in my absence my elder brother might make forgery documents and might sell my parents properties to other for his monetary benefit because I live and earn abroad can you please what are the legal remedies I can take to prevent him to do this this type of activity. Your valuable suggestions will be appreciated.l

Firstly, it is important for you to know that you are only entitled to half of the share of your brother in your father’s property. In case your brother fraudulently transfers the property then you can challenge the legality of such transfer by bringing a civil suit against your brother. Without more delay you should come back to India and claim your share before it’s too late.

Make/File an application before the concern Registry office stating therein the property details and further that the said property is family property and your brother alone has no right to sell or transfer the same.
