How to sell my part of a jointly owned property, other is not willing

04-Mar-2023 (In Property Law)
I have a joint property (residential plot of 1200 sqft) along with my sister in law. We purchased the land in both of our names as a joint property one year ago . Now I wish to sell the land to pay for my loan and other debts, but my sister in law is not interested to sell it . She is also not interested to take the full property in her name and pay me my share of money for the land. How can I legally solve this problem and get my loans paid? We both are Hindus.

File a suit for partition and get your portion separated by metes and bounds in the common plot and sell it to any willing buyer.
Otherwise, you can sell the your share in the property as UDS to any third party.

You have no restriction to sell the undivided 50% of share you have in your name. If you find a prospective purchaser you may convince him and sell the 50% of your undivided share you bought though the sale along with your sister in law. The remaining 50% will be her share.
