How to proceed with partitioning of family owned property

Sir it is our family property . it is being sold . my dad are 4 brothers one of them have separated in 1996 from them. he took his money which he spended on buying the property n didnt make any staml paper. now we are selling that land and now he is asking for his one fourth part. kindly need your help. we dont have any prove that we have given him money that he spended on buying the property
