How to proceed is caretaker is not returning possession of property

16-Aug-2023 (In Property Law)
My house is in different city. I work in different city with my family and lives there. 8 years ago when I got transferred from my native town to different city then I put a person to take care of my house. He lived there with his family for 8 years. Now I retired from the job and want to settle in my native house. But the caretaker family of the house is not ready to give position there and with locals they are threatening us. I didn't give them any property papers and others paper like there is no rent or caretaker agreement. Can I file a case against them in Consumer Court? How long it take to solve this issue in consumer Court???

hi Querist,
Your request will never be heard in consumer forum as by definition of section 2 of Consumer Protection Act, 1986.You are not a consumer. We will need to do a lot of things to get you your house back, which we cannot discuss here but again he is not you tenant I don’t see any light of day here... if he stays for 12 years at your property he will claim adverse possession, which will be against you... contact me through lawrato

you have to file the case relating to this matter in the competent civil court in order to meet your requirement. This case will not stand in the consumer court as this is not a consumer related issue
