How to get the share of property jointly constructed

A building jointly built by my father and uncle is being used by my uncle. Half is on his area, half on ours. The property is demarcated nicely in the deed along with siteplan. How do i get my land back.

Very firstly we have to examine the document where from it appears that the land is owned and possessed by your father and your uncle. In absence of the same you have to satisfy the advocate with whom you are going to seek redress about ownership and only than it could be possible to help you out.

Sorry to state that your question is not very clear if you want to say that inspite of demarcation by way of plan in a deed and if you are not allowed to enjoy your possession then in that case you can file a suit for recovery of possession and if you are in possession then you can obtain injunction against your uncles restraining them from disturbing your peaceful enjoyment of your property and if your property is not partitioned as yet then you can file a suit for partition against them.

Who is/are owner (s) of the property as per the property documents.If you are the sole legal heir of your father's lawful property, you can proceed to claim possession of your father's share in such property.Before going for any real time action, you should get
