How to get Encumbrance Certificate

25-Jul-2023 (In Property Law)
Dear Sir, I have paid off my Home Loan and consequently The registration of the sale deed is also released. Now I want to get the Encumbrance certificate. When I went to the Registrar office (In Ahmedabad-Gujarat) for getting Encumbrance certificate, the people over there dosn't know about what EC is. One of the officer over there told me that I should apply for search certificate. Is search certificate same as Encumbrance certificate? Also my father told me that getting a copy of index page of sale deed is enough? Is this correct. Please help me.

Dear sir
Normally once bank loan is paid then in that case the bank gives back the title deeds. They also give a certificate stating that the bank does not have any claim on the property.

A title report is a seperate thing. It is issued by an advocate and the same is not registered with the sub-registrar. Further the sub- registrars do not give a no encumberance certificates in gujarat.

What you need to do is enter into a release deed with the bank and have the same registered. Once such a deed is registered than the same will be reflected in form no. 6/8 village record.
