How to enforce partition of partnership after father's death

My father expired on 08/02/2017..no will..having only death certificate.now suggest me how to take duplicate copy of papers.also there was partnership with uncle and he don't want to do dividation while i and my mother strongly need ..and what is the process of getting court stay because advocates of that area are friends of uncle.i want to file case in jaipur only..is it possible ???
File the civil suit for partition against the cotenant and other co-owners claiming your share in the alleged property. Hire an advocate for filing suit. For revenue property suit will be filled at revenue court and for civil property suit will be filed at civil court
