How to divide the shortage of land


13-Mar-2025 (In Property Law)
2.52 acres & 2.25 acres of land get partitioned under 2 subdivisions in 1945 by 2 brothers. Later both lands combaied and issued joint patta with area 4.5 acres instead 4.77. As of now how to divide the land by the 2 families now? Extend of land available matches with patta. Hindu

Each party should apply for separate patta as per their documents. For all practical purpose it appears as a typo mistake in the partition deed if the available land does not exceed 4.5 Acres. Explore whether partition deed can be rectified failing which in your subsequent deed you are required to mention the extent of land as per document and also as per patta.
