31-May-2023 (In Property Law)
My sister's mother in law has been evicted to his son from his property and don't want my sister to live in her home even their relationship is not good. We want to file a case on them as they threaten my sister and said do what ever you want..we are safe because we already evicted you from our property and relationship. Kindly guide me if i can file a case on them to protect my sister.

In the given situation, you can immediately lodge a complaint with the police under section 498A of Indian Penal Code for against your in laws on the grounds of cruelty. Also, if you want to take divorce from your husband then you can file a petition of divorce under section 13 of Hindu Marriage Act in the jurisdictional family court. and you can also file a case under section 125 of cr.pc for maintenance

U need not to worry, domestic violence complaint is not a criminal proceeding...court will give you the sufficient time to represent your situation as well as your reply....so be calm and try to convince court for real situation.
