How to deal with father torturing for property after death of mom

27-May-2023 (In Property Law)
My mother died 2 years ago without doing a will, our house was registered on her name. We are two brothers with our kids and wives. My father wanted to have our house and torture our wives, kids and us daily. So we have decided to sell house as per the manual agreement my father take 50% of the amount and give us 25% each to both of us. And he didnt give us cash and force us to buy house with those 25% money and added his name in the registered documents too. We bought house for 10 lacs 30 thousands, I have given cheque of 5,30,000 and he gave cheque of 5 lacs. We dont have written proof that he has taken 50% of the amount from sold original house. It was decided with support of our uncle (brothers of my mom). Now my father again started torturing us saying that he need his share in our new house. I just want to know what are legal option in this case. he is toruturing our wives too. So can they file seperate case for that too?

HI,

in law you can talk about the facts which you have proof off...
if your father have added his name as co-owner then how can you get him out , he will have share in the house as stated and to the extend written in the registry of the house .
moreover its your duty under law to maintain your parents .

There are other measures under law available under law for protection of child and women , you can file a complaint against him in the local police station or women cell depending upon the nature of act .

Thanks

Such cases require 2 types of approaches. One is civil case and another is criminal case. Investigation of each allegation is required to be done at the police level separately. If the police do not carry out the investigation, you have to file a criminal case also in the court. To avoid all these litigation, the other way is to put in an old friend of the family who could talk to both sides and resolve the issues. If you dont get such a person, then alternative is to take the route already explained.
