How to claim share in grandfathers property

My grandfather has two sons and three daughters. and among the two sons one is my father. Another son don't have children. They made partition agreement after attaining majority to me without my signature. Later share of property who wons my big dad sold to their relatives intentionally. Am I claim for the property of my big dad?

If you dissent from the said partition, you can claim your share of the property within 3 years after attaining the age of majority. For that purpose you will have to file a civil suit in the concerned civil court having jurisdiction over the area where your property is situated.

If the entire property was transferred by your grandfather to your grandmother as per his own wish, then you cannot do anything about it. However, if the fact was concealed that there were other legal heirs too to the property, that is your father and then you if your father is deceased , then the same can be challenged in court by seeking cancellation of succession certificate given only in your grandmother's name.

If the property you are claiming right is the ancestral, then you can file suit for your share in the property. You can also get declaration from court that the gift deed is void. First of all you will have to collect all property related papers and consult to the lawyer.
