25-Jun-2023 (In Property Law)
I am one of the legal heirs of a freehold property. There has been no partition. One person is claiming that he also is a legal heir but this is not being agreed to by others. He has gone to court and obtained stay on sale. Can I sell/ transfer my share/rights by an agreement or assignment deed without consent of others. The person who has gone to court is prepared to sign an affidavit that if I execute this sale/transfer then he will withdraw the case and and stay against my share. We are hindu.
