How can we divide property if there in no Will

I need to know if my parents didnt leave a will, and now we siblings mutually want to divide assets, where in west delhi these papers can be made and work can be done. we dont wish to for a court case. and want to divide 3 assets among 3 of us by mutual agreement. please help.

Hi,

You can make family settlement deed and registered in sub-registrar office. the best way is go for suit for partition in which you can mention all of you each your share and take your share by way of court order.

You are three in total (brothers+sister), right?
Make a list of the property owned by your parents, better if site map is also drawn.
Then divide amongst yourselves- record in writing the specific part of eachone share. Then put sign all of you on it, date and place of signing be mentioned. Optional- have 2 witness if possible.
Do this on plane paper. And go to revenue department and register the same. And apply forrecording the same in revenue records. And get separate entitlement.

The best way to do it is by signing a family settlement agreement indicating your rights and those of your siblings qua the 3 assets. The family settlement would have 2 witnesses and register it if you wish to.
