10-Oct-2023 (In Property Law)
12 year, ago I had gave some piece of my property to another party for the use of sudha adhikar . And now I want it back . So can you just let me know how can I revert this back and is it possible if I make a boundary across all my registered plot . Including the piece of the sudha adhikar plot , bcs I have registry including that part That's why I want to make a boundary in all my area
It completely depends on the manner in which you have drafted the document by which you have given rights over your property to the third party. If it is drafted as a lease deed, licence, power of attorney, then it can be revoked in the manner specified and in the absence of a specific clause, by the process of general law. If you are still in possession of the property, you can make a boundary wall, that will only help you, but be prepared the other party would object when you initiate construction. You should contact a lawyer and seek detailed legal advice with all documents.
