How can i get share in my father's self acquired property after death?
09-Sep-2023 (In Property Law)
We are 4 brother. I stay separate from my family. The property of father is on power of attorney. If i want share in that property, can i get share? The property is self acquired. My father is no more. There is another property which was on the name of my father. Father transferred the registry on my mother's name. Can i get share in that property too?
You can get share in the property which has not been transferred. You can file a partition suit in the court. you have every right in the property after your father's death.

You can seek for partition of the father's property and claim your share in it. But the property transferred in your mother's name cannot be shared as of now. Your mother is the absolute owner of the property now and she can use or dispose off the said property at her will.
If the property is self acquired then your parents can exclude you from the estate through a Will or a deed. However, if your parents pass away without executing a Will and without relinquishing the estate through a deed or otherwise then you would definitely get your share in the property. You could get in touch if I could be of any further help to you.
