You have to file a Partition suit before the civil court by producing requiring documents to get your share on the joint property. And I need further clarification as that your grand parents registered any will on the schedule property or not ?

HI
if the property belongs to your grand father, then after the time of your grand father, it will vest on your father and his brother.
If your uncle is staying in your own property of 60 square yards, first file an eviction notice (there is no requirement of a rental agreement between father and his brother). Your lawyer can issue eviction notice after having a look at your title deeds and other documents.
