How can i claim back my token money paid for a property

i have paid byana rs. 50000/- ( JUNE 16) by cheuqe and rs. 100000/- again by cheque after bayana end date, seller given receipt ( for one lac) on simple paper as part payment. now i dont want property,becuasue after sixi month till date he not provided me document for loan purpose. kindly suggest how i take back money in how much time legally. i am rented person in chandigarh and dont want long suffering. in bayana its mention that if no ragistry, money will back without not interest. note: byana with person A and property in name B.

Without going through the contents of your agreement (byana), you cannot be properly advised, as it all depends upon the conditions contained in the agreement.
If your agreement contained a condition of return of money on not fulfilling any other condition, and if that any other condition is not fulfilled, certainly your money can be returned.

The property is not in the name of the person who executed the biana. Hence he was not entitled to execute that biana. Secondly even if we consider that he was the rightful owner, still he has not been able to provide the paperwork. You can go for a criminal complaint pertaining to the first reason.
