How can i claim back my earnest money

28-Jun-2023 (In Property Law)
I have paid advance amount for finalising a property. And I got signature from seller in agreement for paying advance. Unfortunately deal has got cancelled. I don't want to purchase the property. Can I get my advance back ? How can I claim my advance amount? What can I do if seller deny to return my advance?

First, please make a written demand on the vendor claiming refund of the advance money. If no response, arrange to issue a legal notice through your local lawyer. Still, if there is no positive development, file a suit.

Everything depends on what is in the written agreement entered between you and the builder. If there is a provision for the repayment of advance and he denies you can take legal steps for its recovery.
