Hi..My good name is Naina Nupur Bayan. We're Hindus by burth. My mom has a property share along with her sisters in a piece of undivided land. But one of the sister's son sold one part of the undivided land, to some muslim third party broker & has taken money around 4-5lakhs just by showing the land area. And the son of the same sister threatens that even if we get him arrested or something, he would get bail very easily. The son might have forged signature as witnesses to land selling agreement. But the other sisters including my mom never signed any agreement. They denied to sign or agree so that sister's family played this bad trick. So I wanted to know your good & helpful suggestion...I dunno what lawful terms to use to make a lawyer explain my situation, hope you would understand my problem & give a helpful resolution. your matter is a civil dispute. has the third party to whom the land has been sold obtained possession of the undivided land. If possible kindly obtain a certified copy of the sale deed or agreement for sale through which your cousin had sold the land to the third broker. It is advisable to file a suit challenging the authenticity of the Sale Deed and also to file a petition to partition the property at the earliest. once the property is demarcated and partitioned amongst the sisters then if your cousin had sold any property beyond his share you can challenge the sale and claim compensation or the land back. if their is forged signature made by your cousin you can file an FIR against him. But if you wait for a long period you will loose your right to file a suit to claim back the land as you will be barred by limitation.
