Have plot ownership certificate can I apply for loan

Plot bought in 1998 and not registered till and house was built in some part and some part is empty , and was included in gram panchayat records , have house number paying taxes, water bills, electricity bills and have all the original previous linked documents as well, and have sale agreement stamp paper made of rs 20/- in 1998, and have ownership certificate issued from gram panchayat, can you advise me how to register the plot and avail for bank loan. and do the previous owner have any legal rights and if they file any case will that be valid.

You should claim title to the property by adverse possession as the land owner has kept quite for almost 18 years when you went ahead with the construction and possession of property.

Article 65,Schedule I of The Limitation Act prescribes a limitation of 12 years for a suit for possession of immovable property or any interest therein based on title. It is important to note that the starting point of limitation of 12 years is counted from the point of time “when the possession of the defendants becomes adverse to the plaintiff”.

Though your title is imperfect for now, you can approach the courts for declaratory title against the original owner and get your title regularized through courts.

Plz contact the counsel with all the relevant documents. There is a process in which u can register it.
