Harassment caused by neighbors what action can i take

Hello, I own a house in Thane. It has been more than 30 years that I live with my family. Another family bought the land plot right infront of us and constructed their house. Now we pass from within their property to reach the main road. The owner always tortures, fights and abuses us. Whenever we have some renovation they come to fight and harass us and always threaten us that they will block our approach road. They also throw waste and junk in the path we pass from in their property. Its been 30 years now that we have suffered. My family is planning to file a legal case, requesting the indian law to provide a solution and permanent approach road relaxation for my family. I seek help and guidance on how I can proceed and solve this issue. Thank You.

You can file civil suit for the protection of your right of way and access to your house in civil Court.

You should also file criminal complaint against the neighbour for the offences of abusing and threatening you and your family.

In such circumstances it would be appropriate to file civil suit seeking restraining order maintain your right of way and would also be better to intimate the Police station in your jurisdiction about threats.

The Indian Easement Act 1882. allows a person to access the way though others property if thats the only route to reach the property within. Hence you can file a civil as well as criminal complaint against the neighbour. Firstly the criminal complaint for mental torture , abusive behaviour, fights. Secondly file a matter under easement act and officially by the order of court have an access to your property.
