Green Park / Kids Play Area Dispute

08-Sep-2026 (In Property Law)
We have a green area inside our society, which builder earlier said is part of this society, but as soon as all flats are sold he declare that as private property. We then realize in documents, this area is not part of our society, but the only way to reach to that property is through our society only.

Based on the facts stated, the issue requires examination of the sanctioned layout plan, sale deed/agreement, brochure, society documents and records of the concerned authority. If the builder represented the green area as part of the society/common area but subsequently claimed it as private property, such conduct may be legally challengeable, particularly if the representation induced the flat purchasers to purchase the property. Further, if access to the said property is possible only through the society, the question of easement/right of way may also arise. Depending upon the documents and applicable laws, appropriate proceedings may be initiated before the RERA Authority, Consumer Commission or Civil Court. If you require detailed legal consultation and examination of your documents, you may approach us.
