My grand mother gifted a house to my mother by way of giftdeed .my mother died in the year 2010. Later my father and me inherited that property in my name and my fathers name in revenue records at grampanchayat . I am only daughter. I got married in ther year 2013 my father got remarried in the year 2015. And he has a son with second wife. Now i want to get property in my name .as it was gifted by my grand mother to my mother. Is it possible to get the property in my name please advice.here grand mother means my mothers mother. Here property not registered.registeted document in my mothers name.
as per section 14 of the hindu succession act 1956 it is your mother property wherein you got a legitimate right over the schedule property and whereas your father is the surviour of the property along with you having a equivalent share along with you and upon his death you can also claim another half of his share. so please go through section 14 and 8 of the hindu succession act if you are a hindu or else section 372 and 374 for indian succession
